The Waikato River Claim (being part of Wai 30) was filed in the Waitangi Tribunal on 16 March 1987, brought by Robert Te Kotahi Mahuta on behalf of himself, Waikato–Tainui, the members of the Waikato-Tainui Maaori Trust Board and Ngaa Marae Toopu.
On 22 May 1995, a deed of settlement was signed by Te Arikinui, Te Atairangikaahu on behalf of Waikato-Tainui and Rt Hon James Bolger on behalf of the Crown.

In the Deed of Settlement 1995, certain raupatu land claims were settled. The deed did not include the settlement of the following which were determined outstanding claims:
- West Coast Harbours;
- Wairoa and Maioro land blocks; and the
- Waikato River.
The Waikato River as referred to in the Deed of Settlement 1995 is defined as:
"for Waikato–Tainui the Waikato River means "the Waikato River from the Huka Falls to the mouth and includes its water, banks and beds (and all minerals under them) and its streams, waterways, tributaries, lakes, aquatic fisheries, vegetation and floodplains as well as its metaphysical being."
The Crown acknowledged that raupatu was a breach of the Treaty of Waitangi and that the claim by Waikato-Tainui in relation to the Waikato River arises as a result of raupatu.
This was further reinforced by Prime Minister Helen Clarke at Dame Te Atairangikaahu's 40th Koroneihana celebrations last year where it was acknowledged "that the Waikato River claim arises as a result of raupatu."
Prime Minister Helen Clarke said "the Crown invasion was by land and by river and this was a double blow to Waikato-Tainui."
